PromptIt ProTerms of Service

Welcome to PromptIt Pro. These Terms of Service ("Terms") govern your access to and use of the PromptIt Pro website, Pro Studio, and related services (together, the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By using PromptIt Pro, you agree to comply with and be legally bound by these Terms of Service and our Privacy Policy, Refund & Cancellation Policy, and Cookie Policy, each incorporated here by reference. If you do not agree, please do not use the platform.
2. Eligibility and Account Registration
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. By registering, you confirm that the information you provide is accurate and that you have the legal capacity to enter into these Terms. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account.
3. AI Technology Provider
Our core generation services, including image-to-image staging, background removal, and prompt customization, are powered by third-party AI models (including Google Gemini image models). Your use of these services is subject to the technical capabilities, limitations, and occasional inconsistencies of those models, including the possibility that an output does not meet your expectations. We do not guarantee any particular result from a generation.
4. Acceptable Use
You agree not to use the Service to:
- Upload or generate content that is unlawful, infringing, defamatory, obscene, or that violates a third party's intellectual property, privacy, or publicity rights.
- Upload images of a product, person, or brand you do not have the right to use.
- Attempt to reverse-engineer, scrape, or circumvent the Service's security, rate limits, or credit system.
- Use the Service to generate deceptive, fraudulent, or harmful content, including impersonation of a real person or organization without authorization.
- Resell, sublicense, or provide access to the Service to a third party otherwise than as an output you have generated and are entitled to use commercially under Section 6.
You are responsible for all activity under your account, including the legality of images you upload for processing and the outputs you generate from them.
5. Subscriptions, Credits, and Payments
PromptIt Pro operates on a subscription-based credit system, currently offered on a monthly billing cycle only. Each plan includes a monthly credit allowance; credits are consumed for each successful generation based on the model and quality selected, and do not expire while your account remains open. All charges are processed securely through Razorpay; PromptIt Pro never sees or stores your full card or bank details.
You may cancel your subscription at any time from your account's Billing tab; cancellation takes effect at the end of your current billing cycle, and you retain access through the period already paid for. You may upgrade or downgrade to a different plan once you have completed one full month on your current plan. Subscription charges and any eligible refunds are governed by our Refund & Cancellation Policy.
6. Intellectual Property and Content License
PromptIt Pro owns the platform design, software, and the original curated prompt and inspiration collections. You retain ownership of the product photos and brand assets you upload. By uploading content, you grant PromptIt Pro a limited license to process that content solely to provide the Service to you (including sending it to our AI providers for generation).
Ownership and usage rights of AI-generated output are subject to the terms of our underlying AI providers in addition to these Terms. Subject to your compliance with these Terms and payment of applicable credits, we grant you the right to use, reproduce, and commercially exploit the final images generated through your account.
7. Copyright Complaints
If you believe content on the Service infringes your copyright, contact us via our support portal with a description of the work, the allegedly infringing material, and your contact details. We will review and respond to good-faith notices and may remove content or suspend accounts found to be repeat infringers.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated outputs will be accurate, suitable, or free of artifacts.
9. Limitation of Liability
To the maximum extent permitted by law, PromptIt Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service or any inconsistency in an AI model's output. Our total liability for any claim arising from these Terms is limited to the amount you paid us in the three months preceding the claim.
10. Indemnification
You agree to indemnify and hold PromptIt Pro harmless from any claims, damages, or expenses arising from your content uploads, your use of generated outputs, or your violation of these Terms or applicable law.
11. Suspension and Termination
We may suspend or terminate your account for violation of these Terms, fraudulent or abusive use, or non-payment. You may stop using the Service and close your account at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
12. Governing Law and Disputes
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will first be attempted to be resolved informally by contacting our support team.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated revision date, and continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the policies referenced in Section 1, constitute the entire agreement between you and PromptIt Pro regarding the Service.
